Consignment Agreement

This Consignment Agreement (“Agreement”) is entered into as of the date of item drop-off by and between the undersigned consignor (“Consignor”) and Shop Cares Closet (“Consignee”), located at:

By submitting items for consignment, the Consignor acknowledges that they have read, understood, and agreed to the terms and conditions set forth in this Agreement.


1. Purpose

This Agreement outlines the terms and conditions under which the Consignee agrees to accept items from the Consignor for sale on a consignment basis.

2. Consigned Items

  • Consignee will provide an itemized inventory list within 1 to 4 weeks.
  • All pricing decisions, including markdowns or discounts, are at the sole discretion of the Consignee.
  • By proceeding, Consignor agrees to the pricing and terms in the inventory list.

3. Consignment Period and Early Retrieval

  • Standard consignment period: 6 months from acceptance.
  • Early retrieval within 90 days: $250 withdrawal fee.
  • After 90 days, Consignor may request return with 7–14 business days notice.
  • Consignor must collect items within 5–10 business days of notification.
  • Uncollected items will be donated without further notice.

4. Pricing and Commission Structure

Final sale price determined solely by the Consignee. Commission breakdown:

  • Contemporary Designer: 60% to Consignor
  • Luxury Designer: 70% to Consignor
  • Chanel & Hermès Handbags: 80% to Consignor

Item categorization is at Consignee’s discretion and shown in the inventory list.

5. Payment Terms

  • Payments via cheque, e-transfer, or in-store credit.
  • Minimum for cheque/e-transfer: $100 CAD; below that = store credit.
  • Processed within 10–18 business days of payout request.
  • One payout request per month.
  • Consignor must initiate the payout; no automatic payments.

Insurance Disclaimer: No insurance coverage. Not liable for loss, theft, or damage unless due to gross negligence.

6. Unsold Items and Item Condition

  • Unsold items can be returned after 90 days with notice.
  • Must collect within 5–10 business days or they’ll be donated.

Reasons for removal:

  • Damage (e.g., stains, tears, odors)
  • Poor sales performance
  • Quality issues
  • Inappropriate behavior

Condition Requirements: Items must be clean, laundered, and saleable. Unacceptable items may be donated or discarded without notice.

Care & Preparation Fees:

  • Dry Cleaning/Repairs: $25 or market rate
  • Steaming: $1 per item
  • In-House TLC: $5–$10 per item

Behavior Clause: If the Consignor acts abusively, the relationship is terminated. Consequences:

  • $150 admin fee deducted from balance
  • Items must be collected within 5 business days

7. Liability

Consignee will take reasonable care but is not liable for any damage, loss, or theft unless caused by gross negligence. Items are consigned at the Consignor’s own risk.

8. Authentication and Service Fees

Designer Authentication (Required):

  • Entrupy: $50/item
  • If inauthentic: $100 return fee + 5-day pickup deadline or donation
  • All items must be 100% authentic.

Other Service Fees:

  • At-Home Pickup: $50 CAD
  • Mailed Cheque: $10 CAD
  • E-Transfer: $1.50 CAD

9. Final Agreement

  • All items are authentic and in acceptable condition.
  • Consignor agrees to all terms in this Agreement.
  • Violations may result in immediate termination and donation/forfeiture of inventory.
